Agreement to Terms

By downloading, installing, or using Tend ("the app"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the app.

Description of Service

Tend is a habit tracking application that helps you build and maintain daily habits. The app allows you to:

  • Create and manage habits
  • Track daily completions
  • View streaks and statistics
  • Set reminders
  • Sync data across devices via iCloud

Eligibility

You must be at least 13 years old to use Tend. By using the app, you represent that you meet this age requirement.

Your Account & Data

Tend does not require account creation. Your data is stored locally on your device and, optionally, in your personal iCloud account. You are responsible for:

  • Maintaining the security of your device
  • Managing your iCloud account settings
  • Backing up your data

We are not responsible for any loss of data due to device failure, iCloud issues, or app deletion.

Subscriptions & Purchases

Tend Pro

Tend offers an optional premium subscription ("Tend Pro") with additional features. Subscriptions are billed through Apple's App Store.

Billing

  • Payment is charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions in your App Store account settings

Refunds

All purchases are processed by Apple. Refund requests must be submitted to Apple directly through their support channels. We cannot process refunds directly.

Price Changes

We reserve the right to change subscription pricing. Any price changes will apply to subsequent billing cycles after notice.

Acceptable Use

You agree not to:

  • Use the app for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the app
  • Interfere with or disrupt the app's functionality
  • Use the app to infringe on the rights of others
  • Redistribute, sell, or sublicense the app

Intellectual Property

Tend, including its design, code, graphics, and content, is owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

You may not:

  • Copy, modify, or distribute the app
  • Use our trademarks, logos, or branding without permission
  • Create derivative works based on the app

Disclaimer of Warranties

The app is provided "as is" and "as available" without warranties of any kind, either express or implied.

We do not warrant that:

  • The app will be uninterrupted or error-free
  • Defects will be corrected
  • The app will meet your specific requirements
  • Data will never be lost

Tend is a habit tracking tool, not medical or professional advice. We make no claims about health outcomes or results from using the app.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data
  • Loss of profits
  • Personal injury
  • Property damage

Arising from your use of or inability to use the app.

Our total liability for any claims arising from your use of the app shall not exceed the amount you paid for the app or subscription in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the app or violation of these Terms.

Termination

We reserve the right to terminate or suspend your access to the app at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

You may stop using the app at any time by deleting it from your device.

Changes to Terms

We may modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the app after changes constitutes acceptance of the new Terms.

We encourage you to review these Terms periodically.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the app shall be resolved in the courts of competent jurisdiction.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of Tend and supersede any prior agreements.
